Hazardous Materials Data Collection

- Facilities located within Wellhead Protection Zones 1, 2 or 3 are required to submit information regarding the hazardous materials handled at the facility.
- Hazardous Materials Questionnaires are completed with a new business license application and during periodic renewals.
- Hazardous Materials Inventory Statements must be completed by businesses within Wellhead Protection Zones 1, 2, and 3 that handle aggregate quantities of hazardous materials equaling 20 gallons or 200 pounds or more. Facilities located in WHP Zone 4 must complete the HMIS if they facility meets the Fire Departments requirements.
- Hazardous Materials Management Plans must be completed by businesses within Wellhead Protection Zones 1, 2, and 3 that handle aggregate quantities of hazardous materials equaling 50 gallons or 500 pounds or more. Facilities located in WHP Zone 4 must complete the HMIS if they facility meets the Fire Departments requirements.

The owner or operator of the facility shall provide a written notice to Ken Waldo of the Wellhead Protection Program at the same time as reporting the release under either of the following programs:

Wells must be installed, maintained and decommissioned in accordance with the requirements in WAC 173-160.
- The Department of Ecology’s Model Toxics Control Act (MTCA) (Chapter 173-3440-300 WAC) Cleanup Regulations, or
- The U.S. Environmental Protection Agency’s Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) (42 U.S.C. Section 9503c).
The following well activities conducted in Zones 1 and 2 must be reported to Amanda Balzer within 60 days:
- Record and construction details of any well completion regulated under Chapter 173-160 WAC,
- Construction and maintenance of wells, and
- Construction or decommissioning of any well excluded per WAC 173-160-010(2).
Reporting of Completion of Cleanup
Once your site has been cleaned up and you seek closure from the State Department of Ecology or US Environmental Protection Agency, you will be required to provide a copy of the same notification of site closure to Wellhead Protection Program staff.
The owner or operator of the facility shall provide written notice to Amanda Balzer of the Wellhead Protection Program within five (5) business days of receipt of a 'No Further Action' letter from the Department of Ecology, or a final 'Record of Decision from U.S. Environmental Protection Agency', regarding confirmation of cleanup of a release at the facility.
